Walmart filed a class action lawsuit against StarKist Co. in relation to price-fixing.

Contentions

PLAINTIFF'S CONTENTIONS: Walmart claimed StarKist conspired with two other packaged seafood producers to fix, raise, maintain, and/or stabilize prices in violation of the Sherman Antitrust Act. Specifically, Walmart claimed that StarKist agreed to decrease the size of its cans, agreed to collusive list price increases on canned tuna, and agreed to limit promotional activity, which increased its profits.

DEFENDANT'S CONTENTIONS: StarKist denied the contentions.

Result

Walmart and StarKist reached a settlement agreement for $20.5 million.
