James Park, Jessica Park, and Peter Park filed a lawsuit against RVGC Partners, Inc., dba Royal Vista Golf Club, and Se Jung in relation to the death of their decedent, Lisa Park.
Contentions
PLAINTIFFS' CONTENTIONS: Plaintiffs contended that when James and Lisa were at the Royal Vista Golf Course and driving a golf cart in a crosswalk on Colima Road/Golden Springs Road, Lisa was struck by a hit and run driver and died as a result. Plaintiffs contended that defendants had some control over the design of the road crossings, and defendants were negligent.
DEFENDANTS' CONTENTIONS: RVGC and Jung contended that the Department of Public Works installed the signal and crosswalks where Lisa was struck.
Result
The court found that RVGC and Jung had shown that plaintiffs failed to raise a triable issue of material fact in relation to duty and granted defendants' motion for summary judgment.
