Facts
Amanda Lopez-Frausto applied for social security benefits, which was denied both initially and on reconsideration. Lopez-Frausto then requested a hearing in front of an administrative law judge. The ALJ determined that Lopez-Frausto was not disabled and denied her application for benefits. Lopez-Frausto requested review of the ALJ's decision but her requested was denied. Lopez-Frausto then filed suit against Nancy Berryhill, seeking judicial review of the denial.
Contentions
PLAINTIFF'S CONTENTIONS: Plaintiff alleged that the ALJ failed to assert sufficient reasons as to why he found that her subjective complaints were not credible.
DEFENDANT'S CONTENTIONS: Defendant contended that the ALJ correctly founds plaintiff's complaints not credible based upon the fact plaintiff's statements concerning the intensity and persistence of her symptoms based upon her level of activity and evidence found in the medical record.
Result
The court affirmed the defendant's decision in denying plaintiff's application for benefits and finding that she was not disabled.
