Facts
Plaintiff Victoria Macias, a preschool teacher's aide, resigned from the Tulare City School District after 20 years of service. After working at another school for one year, she re-applied. She was again hired by Tulare City School District as a preschool teacher's aide for the 2015-2016 school year.
Plaintiff filed suit against the Tulare City School District after she was terminated in April 2016. Plaintiff was 51 years old at the time.
Contentions
PLAINTIFF'S CONTENTIONS: Plaintiff alleged she was harassed and discriminated against by the preschool teacher and school administration due to her age.
DEFENDANT'S CONTENTIONS: Defendant claimed that as the year progressed, Macias began to have issues with tardiness, and following the directions of the preschool teacher. Eventually, Macias was released from her employment. Defendant contended that plaintiff was released from her employment due to her tardiness for work, and her repeated failures to follow the direction of her immediate supervisor.
