Facts

Jamie Dizon filed suit against Meirong Deng in relation to a traffic collision while Dizon was walking in an intersection.

Contentions

PLAINTIFF'S CONTENTIONS: Dizon contended that while she was walking on the street, Deng struck her with her vehicle and she was thrown on the hood of Deng's car and then fell to the ground. Dizon contended that Deng was negligent in the operation of her vehicle because she was speeding and was distracted.

DEFENDANT'S CONTENTIONS: Deng denied the contentions and contended that Dizon ran into the intersection without looking, from behind parked cars, and while she was intoxicated. Deng contended her view was obstructed and additionally that Dizon was wearing black at night so it was hard to see her. Deng contended that Dizon was negligent.

Result

The jury found in favor of Deng. Although it found that both parties were negligent, it found Deng's negligence was not a substantial factor in causing Dizon harm.
