Plaintiff Effrin Griffin sought judicial review of a denial of a period of disability, disability insurance benefits and supplemental security income.
Contentions
PLAINTIFF'S CONTENTIONS: Plaintiff contended that the administrative law judge erred at step two of the five-step sequential evaluation process. Additionally, plaintiff alleged that the residual functional capacity determination was not supported by substantial evidence because it failed to incorporate his physical impairments. Plaintiff contended that the ALJ's limitation of plaintiff to simple tasks were not adequate in determining plaintiff's moderate limitations in concentration, persistence, and pace.
DEFENDANT'S CONTENTIONS: Defendant contended that plaintiff had no severe physical impairments at step two and had the physical residual functional capacity to perform a full range of work at all exertional levels.
Result
The court found that the ALJ did not properly consider plaintiffs impairments, reversed the commissioner's decision to deny benefits and remanded the matter to the Commissioner.
