Facts

Alfredo Catalan Rosas sought judicial review of the Commissioner of Social Security's denial of his application for disability insurance benefits.

Contentions

PLAINTIFF'S CONTENTIONS: Rosas alleged the administrative law judge erred by failing to consider the opinions of two state agency reviewing psychiatric physicians, the findings of the Department of Veterans Affairs, and records of his migraine headaches, in determining his residual functional capacity. Further, Rosas claimed the testimony of he and his wife were improperly rejected.

DEFENDANT'S CONTENTIONS: Defendant contended the ALJ did not commit error and the determinations were supported by substantial evidence.

Result

The court affirmed the Commissioner's decision. The court found the ALJ properly rejected the testimony of Rosas and his wife because the statements were not supported by the medical evidence and Rosas responded positively to conservative treatment and medications. Further, the court found the ALJ properly considered and gave partial weight to the opinions of the two state agency reviewing psychiatric physicians, and properly rejected the Department of Veterans Affairs' disability rating because Rosas's mental health symptoms were effectively controlled with medication and therapy. The court also concluded that Rosas did not specify what limitations the ALJ failed to incorporate into Rosas's residual functional capacity resulting from his migraine headaches, and no medical opinions showed the headaches limited Rosas's ability to perform light work.
