Contentions

PLAINTIFF'S CONTENTIONS: Plaintiff contended that defendant's Personal Cloud product infringed on its patent for personal data backup.

DEFENDANT'S CONTENTIONS: Defendant contended that the patent is directed at unpatentable subject matter.

Result

The court granted defendant's motion to dismiss. It found that the claim was directed to an abstract idea and there is no inventive concept sufficient to save the claim. Therefore, the patent was directed at unpatentable subject matter under 35 U.S.C. Section 101.
