Vanessa Camorlinga and Angela Mammina filed a putative class action against Zara USA Inc. in relation to Zara's employment and compensation practices.
Contentions
PLAINTIFFS' CONTENTIONS: Plaintiffs claimed Zara did not pay overtime, failed to provide proper meal and rest periods, failed to provide employees with accurate itemized wage statements, did not pay full wages when due and waiting time penalties, and unfair business practices.
DEFENDANT'S CONTENTIONS: Zara denied the allegations and sought dismissal of plaintiffs' complaint in its entirety.
Result
The court granted preliminary approval of a settlement agreement reached between the parties. Under the agreement, Zara agreed to pay $1.82 million to settle plaintiffs' claims. Of this sum, $606,060 would be paid in attorney fees, no more than $22,000 would be paid in costs, and $10,324 would be paid in administration costs. Additionally, each named plaintiff would receive an enhancement award of $7,500.
