Nisha Brown and Kathy Williamson filed a class action lawsuit against Walmart Inc. in relation to cashiers' seats.

Contentions

PLAINTIFFS' CONTENTIONS: Plaintiffs contended that Walmart failed to provide cashiers with seating and thus violated California's suitable seating statute.

DEFENDANT'S CONTENTIONS: Defendant denied the contentions.

Result

After ten years of litigation and less than one month before trial, the parties reached a settlement agreement under California's Private Attorneys General Act for $65 million. Under the terms of the settlement, the California Labor and Workforce Development agency will receive 75 percent of the net settlement fund and the class members will receive $10,710,875, which is 25 percent of the net settlement fund. The court awarded class counsel $21,664,500 in attorney fees and $312,000 in litigation costs.
