Plaintiff Erwinthanshea Boyd sought judicial review of the Commissioners decision to deny him supplemental security income.
Contentions
PLAINTIFF'S CONTENTIONS: Plaintiff contended that the Administrative Law Judge erred at step two in determining that plaintiff does not suffer from a severe mental impairment. Plaintiff alleged that the ALJ's step two finding that his mental impairment was non-severe was not supported by substantial evidence. Plaintiff contended that the fact that he is able to take care of his son is not a good reason to show that he does not have a disability.
DEFENDANT'S CONTENTIONS: Defendant alleged that the ALJ found plaintiff suffered from affective mood disorder and substance addiction disorder but the ALJ concluded that these impairments were not severe. Defendant contended that plaintiff had no limitations in his activities of daily living. Defendant contended plaintiff was able to take care of his son without assistance and was capable of self-care. Defendant contended that plaintiff had no problems with his routine and daily living.
Result
The court affirmed the judgment of the Commissioner and found that plaintiff is not disabled.
