Plaintiff Diane Duncan Brooks sought judicial review of a final decision of the Commissioner of Social Security denying her application for disability insurance benefits.
Contentions
PLAINTIFF'S CONTENTIONS: Plaintiff contended that she is unable to work where it is required for her to write manually. Plaintiff alleged she cannot hold a pen for too long because it hurts all the way to her elbow due to her reflex sympathetic dystrophy. Plaintiff alleged that the decision of the ALJ was not supported by substantial evidence in finding that her physical impairment didn't qualify as a disability.
DEFENDANT'S CONTENTIONS: Defendant alleged that the ALJ found that plaintiff had not engaged in substantial gainful activity during the period of her alleged disability. The ALJ determined that the severity of plaintiff's impairments did not meet or equal any of the listed impairments. Defendant contended that plaintiff had the residual functional capacity to perform sedentary work and could perform her past relevant work as a court clerk.
Result
The court denied plaintiff's appeal from the Commissioner's decision because it was supported by substantial evidence in the record.
