Case number: EDCV 18-0104-KS Bench Decision –  Plaintiff

Judge

Karen L. Stevenson

Court

CD CA

Attorneys

Plaintiff

Brian C. Shapiro
(Law Offices of Lawrence D. Rohlfing)

Defendant

Tina R. Saladino
(Social Security Administration)

Facts

Jacqueline Bentiste filed suit against the Commissioner of Social Security, in relation to the denial of her application for Supplemental Security Income.

Contentions

PLAINTIFF'S CONTENTIONS: Bentiste contended that the administrative law judge erred in finding she did not have any severe mental impairments. She contended she suffered from depressed mood, irritability, social isolation, hallucinations and paranoid delusions.

DEFENDANT'S CONTENTIONS: Defendant denied the contentions.

Result

The court found that the administrative law judge gave little weight to the examining physician's medical opinions. Three doctors that agreed Bentiste had a severe mental impairment and none of the administrative law judge's reasons for rejecting these opinions were legally sufficient. As a result, the error warranted remand.
