Thanh Vo, a paraplegic, filed a lawsuit against Howard Yoo in relation to her access at defendant's restaurant, Cha Thai.

Contentions

PLAINTIFF'S CONTENTIONS: Plaintiff requires the use of a wheelchair and a modified accessible van. Plaintiff contended that she visited defendant's restaurant and there were no parking spaces configured for van accessible, which meant that there was no room for the ramp on her van to fold out, making it difficult to exit her vehicle. Moreover, plaintiff contended that the property's pathways were excessively sloped, which made it difficult for her to travel throughout the property. Plaintiff asserted causes of actions for violations of the Unruh Civil Rights Act and the Americans with Disabilities Act.

DEFENDANT'S CONTENTIONS: Defendant denied the contentions.

Result

The court granted summary judgment in favor of plaintiff and awarded her $4,000 in statutory damages.
