Emmett Waldrip, an incompetent born September 9, 1927, through his conservator Dixie Waldrip, filed suit against the City and County of San Francisco in relation to medical care provided to him at the San Francisco General Hospital on November 27, 2016.
Contentions
PLAINTIFF'S CONTENTIONS: Plaintiff contended that defendants negligently failed to attend to him while he was a patient, and he was left unattended and unsecured on a gurney. Plaintiff alleged he fell from the gurney, landed on the floor, and fractured his humerus. Plaintiff contended that defendants knew he was at a high risk of falling, and needed additional precautions in place.
DEFENDANT'S CONTENTIONS: Defendants neither admitted nor denied the allegations.
Result
The parties agreed to a settlement under which defendants agreed to pay $125,000 to settle plaintiff's claims.
