Plaintiff David Rademaker, a state prisoner, filed a lawsuit against defendants regarding his treatment while he was incarcerated at the Richard J. Donovan Correctional Facility.
Contentions
PLAINTIFF'S CONTENTIONS: Plaintiff contended that defendants violated his first amendment constitutional right to free exercise of religion when they failed to provide him with a kosher diet because plaintiff was a kosher-observing Jewish prisoner. Plaintiff further argued that he was not provided with adequate kosher meals for two years.
DEFENDANT'S CONTENTIONS: Defendants denied the allegations and contended that plaintiff was consistently
provided with kosher meals throughout the day. Additionally, defendants argued that the manner in which plaintiff received his meal did not burden his religious practices.
Result
The court entered judgment granting defendant's motion for summary judgment on the grounds that there was no issue of genuine material fact and plaintiff failed to state a valid claim for which relief could be granted because there was no substantial burden on plaintiff's practice of religion.
