Jamie and Andrew Hoffer filed a lawsuit against Linus Bike, Inc. to recover damages arising from a bicycle accident.

Contentions

PLAINTIFFS' CONTENTIONS: Plaintiffs contended that Linus Bike failed to provide Jamie Hoffer a helmet with her rental bike prior to her accident.

DEFENDANT'S CONTENTIONS: Defendant contended that it did not owe a duty to plaintiffs. It merely had a contract with the Mob Shop and Ojai Valley Inn and Spa to provide bikes for their patrons. All duties associated with providing safety equipment fell on those entities.

Result

The court granted defendant Linus Bike's motion for summary judgment.
