Sayed Nazim Ali filed a lawsuit against his employer, Robert Half International, Inc., over alleged violations of the Americans with Disabilities Act.
Contentions
PLAINTIFF'S CONTENTIONS: Plaintiff contended that he was not provided with a permanent work station and had to move from room to room in order to complete his assigned tasks. As a result, he contended that he suffered stress, anxiety, and high blood pressure. He contended that when he complained about the situation, he was terminated. Plaintiff contended that defendant failed to accommodate his disability and discriminated against him in violation of the Americans with Disabilities Act.
DEFENDANT'S CONTENTIONS: Defendant contended that plaintiff was not disabled within the meaning of the ADA. Defendant contended that without a disability it was not required to accommodate plaintiff and could not have discriminated against him. Defendant filed a Rule 12(b)(6) motion for failure to state a claim upon which relief could be granted.
Result
The court granted defendant's motion to dismiss.
