Facts

Plaintiff Dr. Charles Roberts was employed with Hayward Unified School District from 2015 through 2017 as the Chief Facilities Officer. He was laid off in August 2017 due to a district-wide reorganization to save money to the district's general fund at the direction of the District's Board of Directors. The reorganization eliminated his position.

At the start of trial, plaintiff alleged causes of action for age and race discrimination under FEHA. At the close of evidence, plaintiff dismissed the age discrimination cause of action.

Contentions

PLAINTIFF'S CONTENTIONS: Plaintiff contended he was laid off due to a district-wide reorganization and that his performance was exceptional and therefore he was told not to re-apply because of his age and race.

DEFENDANT'S CONTENTIONS: Hayward Unified School District contended that it laid off plaintiff due to a district-wide reorganization that eliminated his position, and he was told he would likely not be re-hired because of his poor performance. Plaintiff's age and race were not factors in the reorganization or the post-reorganization discussion regarding the new positions.

Hayward Unified School District presented evidence that plaintiff's performance was inadequate, the Board of Director's complained about his performance, and there was no evidence of any racially motivated conduct or discrimination by the district.

Plaintiff demanded $1.3 million prior to trial. Hayward Unified School District made no offers prior to trial.

Injuries

Plaintiff sought damages for lost wages and emotional distress. At the time of trial, he had not found replacement employment.

The jury returned a verdict in favor of the defense.
