Facts
Cotijas Taco Shop is a 50 patron restaurant in San Diego, California. David Ruiz is the President of Cotijas Taco Shop. On August 26, 2017, Floyd Mayweather staged a fighting exhibition against Colin McGregor on pay-per-view. The shop was open for business and showed the fight on television for its patrons.
Contentions
PLAINTIFF'S CONTENTIONS: Plaintiff contended that it had the sole and exclusive right to broadcast the fight. Plaintiff contended that defendant exhibited the fight without plaintiff's approval or knowledge.
DEFENDANT'S CONTENTIONS: Defendant contended that he was merely leasing the premises to one Enrique Hernandez. Since he was leasing the premises, he was not responsible for showing the fight or any alleged piracy.
Result
The court granted defendant's motion for summary judgment.
