Volkswagen Group of America Inc. filed a trademark infringement lawsuit against EMD Auto in relation to its Audi and Volkswagen marks.

Contentions

PLAINTIFF'S CONTENTIONS: Plaintiff contended that defendant made counterfeits of its Audi and Volkswagen marks and advertised them for sale. Plaintiff also contended that defendant advertised and sold counterfeit parts or accessories for Audi or Volkswagen vehicles.

DEFENDANT'S CONTENTIONS: Defendant contended that it did not infringe plaintiff's trademarks.

Result

The parties reached a settlement agreement. Defendant agreed, via a permanent injunction, to cease use of the marks.
