Facts

In May 2013, Michelle Coyle had lunch on the outdoor patio at the Mission Inn Hotel and Spa. She was bit by a Black Widow spider. She filed a lawsuit against the Mission Inn over its maintenance of the patio.

Contentions

PLAINTIFF'S CONTENTIONS: Plaintiff contended that defendant negligently maintained their property, resulting in her being bitten as an invitee. Plaintiff contended that she suffered severe short-term injuries as a result of her bite, and permanent injuries to her left hand and foot.

DEFENDANT'S CONTENTIONS: Defendant contended that its maintenance of the property exceeded the standard of care. Defendant contended its patio was subject to weekly pest control inspections and treatments. Defendant contended there was no alternative that would have lowered plaintiff's probability of being injured.

Result

The jury found for the defendant.
