Facts

On June 10, 2017, 68-year-old Alan Mulder's landscaping trailer was parked in Agoura Hills. As he was approaching the trailer on foot, he was suddenly struck by another vehicle. The vehicle left the scene and Mulder ultimately died. His estate filed a lawsuit against Sarah Fields, the driver of the vehicle, to recover the cost of Mulder's death.

Contentions

PLAINTIFF'S CONTENTIONS: Plaintiff contended that defendant was both, driving at an excessive rate of speed, and under the influence of sedatives at the time of the collision. Plaintiff contended that defendant was negligent and that her negligence resulted in Mulder's death.

DEFENDANT'S CONTENTIONS: Defendant denied she was speeding and contended that the medication was taken in a lawful and healthy dosage to treat her seizures and anxiety.

Result

The parties reached a $2.3 million settlement agreement. Defendant's primary insurer will pay $300,000 and her umbrella insurer will pay $2 million.
