Jerry Krause filed a lawsuit against the City of Vallejo under the Americans with Disabilities Act.
Contentions
PLAINTIFF'S CONTENTIONS: Plaintiff contended that the city's parking lots are inaccessible and unavailable to him as a wheelchair user. Plaintiff contended that he could not deploy the handicap ramp from his van due to barriers in the parking lots. Plaintiff contended that the city's accessibility issues violated the Americans with Disabilities Act.
DEFENDANT'S CONTENTIONS: Defendant contended that its parking lots did not violate the ADA and plaintiff's use was otherwise unencumbered.
Result
The parties reached a settlement agreement. Defendant agreed to pay plaintiff $40,000 to settle the claim. Defendant also agreed to construct handicap accessible spaces by May 30, 2020.
