Facts
On April 28, 2016, Robert Snell was driving his vehicle. He attempted to make a turn onto southbound Bolsa Chica Road in Huntington Beach. As he pulled into the intersection, his vehicle collided with another vehicle driven by Lance Quinn. Snell filed a lawsuit against Quinn to recover from his injuries.
Contentions
PLAINTIFF'S CONTENTIONS: Plaintiff contended that defendant was negligent because defendant was driving over the speed limit and that defendant's negligence caused him to suffer severe back injuries.
DEFENDANT'S CONTENTIONS: Defendant claimed that plaintiff caused the accident by pulling out in front of him when it was unsafe to do so.
Result
The jury found plaintiff 85 percent negligent and defendant 15 percent negligent. The jury found damages amounted to $121,368. Plaintiff filed a motion for additur that was granted, adding $50,000 in past pain and suffering damages and $50,000 in future pain and suffering damages, for a total verdict of $221,368.
