Facts

Plaintiff U.S. Equal Employment Opportunity Commission, filed suit against defendant Maurizio Trattoria Italiana LLC, who allegedly violated Title VII, the Pregnancy Discrimination Act of 1978, and Tile I of the Civil Rights Act of 1991.

Contentions

PLAINTIFF'S CONTENTIONS: Plaintiff contended defendant unlawfully discriminated against former server Elena Boni because of her pregnancy, a condition of her sex, childbirth and/or related medical condition. Plaintiff contended after defendant was notified of plaintiff's pregnancy defendant reduced plaintiff's hours, which resulted in substantially less pay. Further, plaintiff contended after the server gave birth, defendant refused to let Boni return to her position as a server and fired her instead.

DEFENDANT'S CONTENTIONS: Defendant denied plaintiff's contentions.

Result

The parties entered into a settlement agreement for the amount of $18,800 and injunctive relief. The order for injunctive relief required defendant to take proactive measures that cultivate a work environment free from discrimination and employment practices that complied with federal laws. Defendant's managers and employees will be trained with regard to sex, specifically pregnancy discrimination, and provided with ways to effectively handle pregnancy discrimination complaints.
