PLAINTIFF'S CONTENTIONS: Plaintiff contended defendant trustee Roebuck entered into an agreement to settle a fee dispute with plaintiff for $100,000 but defendant failed to pay the fee. Plaintiff alleged breach of contract claim.
DEFENDANT'S CONTENTIONS: Defendant denied plaintiff's contentions and further contended plaintiff breached its fiduciary duty when it sued its client defendant for a legal fee. Defendant also contended plaintiff breached its fiduciary duty, when it used information plaintiff claimed was learned by the attorneys, during the time the attorney-client relationship existed.
Defendant filed a cross-complaint, alleging fraud and breach of fiduciary duty.
