Facts
Michael Torres filed an application for disability benefits on Jan. 21, 2016. The application was denied in the first instance and upon reconsideration. On March 6, 2018, an ALJ found that Torres was not disabled. Torres petitioned the superior court for reconsideration of the ALJ's finding.
Contentions
PLAINTIFF'S CONTENTIONS: Plaintiff contended that he has osteoarthritis in his knees and that he can hardly walk. Plaintiff contended that he is extremely obese. Plaintiff contended that his inability to walk and his obesity render him unable to work.
DEFENDANT'S CONTENTIONS: Defendant contended that plaintiff's conditions did not render him disabled within the meaning of the Social Security Act. Defendant contended that plaintiff was able to fulfill numerous jobs within the national economy.
Result
The court granted defendant's motion for summary judgment. The ALJ properly found by clear and convincing evidence that plaintiff was not disabled.
