On April 1, 2016, Joan Gibson, 61, was driving on Bundy Drive in Los Angeles. Her pickup truck was suddenly broadsided by a pick-up truck driven by one Kyle Foster. Foster was making a left from West Pico Blvd. onto Bundy Drive.
Contentions
PLAINTIFF'S CONTENTIONS: Plaintiff contended that defendant was negligent in the operation of his vehicle and caused the collision. Plaintiff contended that she suffered severe injuries to her knees.
DEFENDANT'S CONTENTIONS: Defendant contended that plaintiff was driving too fast for the traffic conditions and was comparatively at fault for her injuries.
Result
The jury found defendant 85 percent at fault and plaintiff 15 percent at fault. It found plaintiff sustained $85,000 in damages. Plaintiff consequently received $72,250 upon apportionment.
