On June 1, 2016, Vandy Nou was driving south on Interstate 5. Her car was rear-ended by a vehicle driven by Juan Serrato. Nou's vehicle then struck a vehicle driven by Brenda Herrera. Nou and Herrera each sued Serrato in response. The cases were consolidated.
Contentions
PLAINTIFF'S CONTENTIONS: Plaintiffs contended that defendant negligently operated his vehicle and caused both collisions. Both plaintiffs contended that they suffered injuries to their neck and back.
DEFENDANT'S CONTENTIONS: Defendant contended that plaintiff Herrera cut-off his vehicle. Defendant contended that plaintiff Herrera was 100 percent liable for the collisions.
Result
The jury returned a verdict for the plaintiffs. Defendant was found 100 percent liable for the collision. The jury awarded plaintiff Nou $76,273.68 and plaintiff Herrera $7,580.
