Facts
Plaintiff Mario Garcia was arrested for suspicion of driving while intoxicated. During the booking process, Garcia matched to an outstanding Los Angeles County felony bench warrant and was transferred to the custody of the Los Angeles County Sheriff's Department. However, two days later the court determined that Garcia was not the person related to the warrant. Garcia sued the Los Angeles County and the former Sheriff Leroy Baca.
Contentions
PLAINTIFF CONTENTIONS: Plaintiff alleged that he was wrongly held in custody.
DEFENDANTS CONTENTIONS: Defendant argued that Garcia was provided an opportunity to appear before a judge to protest the mistaken identity but he refused, and that Garcia never complained that he was not subject to the warrant.
Result
The parties settled and defendants agreed to pay $150,000.
