Plaintiff Maria Asela Caces-Tiamson sued defendant Equifax in relation to a data breach announced in September 2017.
Contentions
PLAINTIFF'S CONTENTIONS: Plaintiff contended that defendant failed to respond to her letter claiming that she had been a victim of a data breach that occurred. Plaintiff contended that defendant's failure to respond to her letters formed a contract whereby defendant admitted her contentions and agreed to be liable for all of plaintiff's damages.
DEFENDANT'S CONTENTIONS: Defendant contended that plaintiff's complaint should be dismissed for lack of personal jurisdiction and for failure to state a claim upon which relief can be granted.
Result
The court dismissed the case for lack of personal jurisdiction. Judgment was entered in favor of defendant.
