Plaintiff Nadia Agha was driving on a highway with co-plaintiff Fadia Al Hawash seated in the passenger seat when they were rear-ended by a vehicle driven by defendant Steven Harris.

Contentions

PLAINTIFFS' CONTENTIONS: Plaintiffs contended that defendant was negligent in operating his motor vehicle when he rear-ended plaintiff's vehicle while it was fully stopped.

DEFENDANT'S CONTENTIONS: Both Defendant third party/State Farm and the UIM Respondent/Nationwide disputed causation.

Damages

Plaintiff Agha sought for $92,200 in damages for medical expenses, $35,000 for past wage losses and $770,000 to $960,000 in future medical costs. In addition, plaintiff Agha sought for damages for future earning capacity, and pain and suffering.

Injuries

Plaintiff Agha claimed that the motor vehicle accident resulted to injuries to her head, neck, back and chest. Agha further claimed that she suffered a concussion, chest contusion and type-B aortic dissection. The aortic dissection was a permanent damage to Agha's heart, which will require future medical care.

Result

The parties settled the case for a total of $800,000. State Farm tendered its policy limit of $100,000. Thereafter, Respondent Nationwide settled the UIM claim for an additional $700,000.
