Facts

Joan Dower was riding in a tour bus on the Embarcadero in San Francisco when the bus was involved in a collision. Joan later sued Open Top Sightseeing USA, Open Top Sightseeing San Francisco, and John Frederick Kennedy for her claimed injuries.

Contentions

PLAINTIFF'S CONTENTIONS: Plaintiff contended that defendants failed to effectively implement and train their drivers on accident prevention safety standards and protocol. Plaintiff further contended that defendants were liable for the negligent operation of their truck, which caused plaintiff's injuries.

DEFENDANTS' CONTENTIONS: Defendants denied the contentions.

Damages

Joan Dower claimed loss of enjoyment and ability to work.

Injuries

Joan Dower suffered from a cervical fracture, excessive soft tissue damage to her knee, hyperextension in her knee, and trimalleolar fracture to her left leg. Joan also suffered a fibular fracture, sprained left shoulder joint and endured treatments accordingly.

Result

Plaintiff and cross-defendant Tu Quy Din settled for $50,000.
