Brent Anderson and other hourly-paid employees that included store managers, assistant managers, and associates, filed a wage and hour class action lawsuit against The Sherwin-Williams Company.
Contentions
PLAINTIFFS' CONTENTIONS: Plaintiffs contended Defendant violated Labor Code Section 203 when Defendant failed to pay all of its employees' proper wages; proper overtime; and further failed to provide all meal periods. Plaintiffs further contended Defendant violated many derivative actions when it failed to timely furnish accurate itemized wage statements and failed to fully reimburse work-related expenses. Plaintiffs lastly contended Defendant violated the California Labor Code, and applicable Wage Orders issued by the California Industrial Welfare Commission when it failed to pay the class members all wages owed for all of the hours worked by the employees.
DEFENDANT'S CONTENTIONS: Defendant denied the contentions.
Result
The parties agreed to settle for $3.65 million including $912,500 in attorney's fees.
