Facts

Plaintiff Socorro Jacobo Aguilar sought review of the Commissioner of Social Security's decision denying plaintiff's application for Social Security benefits and disability insurance benefits. Plaintiff alleged to have suffered from breast cancer, uterus cancer, depression, and arthritis in the knees.

Contentions

PLAINTIFF'S CONTENTIONS: Plaintiff contended defendant erred in concluding plaintiff was not disabled. Plaintiff contended defendant erred by failing to analyze the opinions of her doctors in accordance with Ninth Circuit precedent, agency policy, and federal Social Security regulations.

DEFENDANT'S CONTENTIONS: Defendant denied the contentions, and contended although the administrative law judge determined plaintiff suffered from a history of breast cancer, uterus cancer, major depressive disorder, migraine headaches, seizure disorder, and arthritis, plaintiff's impairments failed to amount to medically severe impairments. Defendant further contended it gave little weight to the opinions of the physicians who treated plaintiff because they were inconsistent with the medical evidence on the record. Lastly defendant contended plaintiff had the residual functional capacity to perform work as a package machine operator and farm fruit worker as plaintiff had previously worked.

Result

The court entered judgment in favor of plaintiff after it concluded the ALJ failed to properly apply the correct legal standards in its evaluation of plaintiff's treating physicians and erred when it determined plaintiff was not disabled.
