Facts

Plaintiff Rosa Rivera Keel filed a lawsuit against the City and County of San Francisco in relation to an alleged dangerous condition of public property.

Contentions

PLAINTIFF'S CONTENTIONS: Plaintiff contended that her left foot got caught in a deep hole in the pavement as she walked through a crosswalk located on Davis Street at the intersection of Clay Street, which constituted a dangerous condition of public property. Plaintiff contended the dangerous condition of public property caused her to lose her balance and fall. Plaintiff further contended defendant was negligent in failing to inspect and repair the damaged pavement that resulted in plaintiff's injuries.

DEFENDANT'S CONTENTIONS: Defendant denied the contentions, moved to dismiss the claims, and asserted various affirmative defenses.

Result

The parties agreed to settle for $75,000.
