Facts

Plaintiff Maria V. sought judicial review of the Commissioner of Social Security's decision, denying her application for Disability Insurance Benefits.

Contentions

PLAINTIFF'S CONTENTIONS: Plaintiff alleged she suffered from back pain, diabetes, high blood pressure, and hypercholesterolemia. Plaintiff contended the administrative law judge erred when it determined she was not disabled because the ALJ determined plaintiff suffered from degenerative disc disease of the lumbar spinal and thoracic spinal areas and obesity. Plaintiff additionally contended the ALJ improperly considered her treatment records produced by her treating physician; failed to properly assess her Residual Functional Capacity and find her diabetes as a severe impairment; and erroneously concluded plaintiff could have performed other work, which was was not supported by substantial evidence in the record.

DEFENDANT'S CONTENTIONS: Defendant denied the contentions and contended plaintiff was not disabled because she did not have an impairment or combination of impairments that met or medically equaled the severity of a listed medical condition. Defendant contended plaintiff could have performed other work.

Result

The court granted defendant's motion for summary judgment in concluding that plaintiff failed to meet her burden that established she was severely impaired from her alleged impediments.
