Facts

Erin Sheeran's daughter, Cara Sheeran, was being loaded into an ambulance and was injured further in the process. As a result, Erin sued the City and County of San Francisco as well as its emergency medical technician employee Raymond Lee.

Contentions

PLAINTIFF'S CONTENTIONS: Plaintiff contended that defendants were all liable for the injuries sustained by her daughter. Plaintiff further contended that EMT Lee made several inappropriate comments to her daughter and choked her. Plaintiff also contended that Lee grabbed Cara's arm in such a way that caused a fracture in three places. Plaintiff also contended that the other EMT failed to prevent Lee from injuring Cara. Plaintiff also contended that defendants acted with intent to cause injury to her daughter and willfully disregarded her rights and safety.

DEFENDANT'S CONTENTIONS: Defendants denied the contentions.

Injuries

Cara Sheeran suffered from three radial ulna fractures and severe mental, emotional, and physical distress.

Result

The EMT was fired for his conduct, and the officer who was present during the assault was released from his probationary period as a SFPD. The parties entered into a $100,000 settlement agreement.
