Facts

Plaintiff Annette Robinson sought judicial review of a decision by the Commissioner of Social Security who denied plaintiff's application for Social Security Disability Insurance benefits and Supplemental Security Income benefits.

Contentions

PLAINTIFF'S CONTENTIONS: Plaintiff contended Defendant erred when it determined Plaintiff was not disabled although Defendant previously concluded Plaintiff suffered from the severe impairments of morbid obesity, a back injury, depression, arthritis, scoliosis, fibromyalgia, sleep apnea, Hashimoto's disease, heart disease, and high cholesterol. Specifically, Plaintiff contended Defendant erred when it failed to determine the severity of her fibromyalgia/chronic pain syndrome and when Defendant improperly considered the medical evidence of Plaintiff's fibromyalgia when she was assessed at step 4 of the Residual functioning capacity. Plaintiff additionally contended Defendant erred when it improperly considered the relevant medical evidence of the record when it assessed Plaintiff's RFC. Lastly Plaintiff contended defendant ALJ improperly considered Plaintiff's subjective testimony that involved her personal complaints about her impairments, pain symptoms, and limitations she experienced.

DEFENDANT'S CONTENTIONS: Defendant denied Plaintiff's contentions and further contended the ALJ properly determined that Plaintiff was not disabled because Plaintiff only suffered from asthma; obesity; back pain/joint disorder; and sleep apnea, but could have worked as a bookkeeper, clerical assistant, social worker, and schoolteacher.

Result

The court ruled in favor of Plaintiff and reversed the Commissioner's decision.
