Alan Moreno filed a putative wage and hour class action complaint on behalf of similarly situtated delivery drivers against his former employer Beacon Roofing Supply, Inc. The claims were brought pursuant to California's Private Attorneys General Act.
Contentions
PLAINTIFFS' CONTENTIONS: Plaintiffs contended that defendant did not reimburse plaintiffs for business expenses for deliveries, which led to plaintiffs resorting to the use of their personal cell phones to complete tasks while at work. Plaintiffs also contended that defendant had a policy of failing to reimburse its drivers for certain work and use of personal devices.
DEFENDANT'S CONTENTIONS: Defendant denied the contentions.
Result
The court approved a $230,000 settlement agreement between the parties that included a $10,000 for Moreno, $105,000 as attorneys' fees and costs, and $10,000 to the Settlement Administrator.
