Facts

Plaintiff Greg G.C., sought judicial review of a final decision by the Commissioner of Social Security that denied Plaintiff's application for Disability and Disability Insurance Benefits.

Contentions

PLAINTIFF'S CONTENTIONS: Plaintiff contended the Administrative Law Judge erred when it failed to provide clear and convincing reasons as to why it determined Plaintiff was not disabled after Defendant determined Plaintiff suffered from degenerative disc disease of the lumbar spine and dysfunction of major joints. Specifically, Plaintiff contended the ALJ failed to properly identify a significant range of work that Plaintiff could have performed at step five of the assessment.

DEFENDANT'S CONTENTIONS: Defendant denied Plaintiff's contentions and contended Plaintiff had not engaged in substantial gainful activity since June 17, 2015, the alleged onset date he became disabled, but nonetheless maintained a residual functional capacity that would have allowed Plaintiff to perform light work. Defendant also contended Plaintiff did not have an impairment or combination of impairments that medically equaled the severity of one of the listed impairments. Additionally Defendant contended Plaintiff maintained at least a high school education, communicated in English, and acquired work skills from past relevant work that applied to other occupations, such as a machine shop supervisor or inspecting machine operator.

Result

The court ruled in favor of Plaintiff and reversed the Commissioner's decision.
