Facts

Charmie Ruffy was a non-exempt Assistant Manager for Island Hospitality Management, Inc. at their Residence Inn by Marriott located in San Jose. Ruffy was an hourly employee and her duties included, among other things, driving the hotel shuttle vans, covering front desk agents on break, review emails, and complete guest check ins. She filed suit a wage and hour class action lawsuit against Island Hospitality Management.

Contentions

PLAINTIFFS' CONTENTIONS: Plaintiffs contended that defendant failed to provide timely payment of properly calculated regular and overtime payments. Plaintiffs also contended that defendants did not provide off-duty meal and rest breaks as required by law. Moreover, plaintiffs' wage statements were not properly itemized and did not include defendants' proper business name and address as required by law.

DEFENDANT'S CONTENTIONS: Defendant denied the contentions.

Result

The case settled for $428,000.
