Facts

On May 22, 2008, plaintiff David Timothy Rudolf was riding his bicycle on Cesar Chavez Avenue in San Francisco when he was ejected from his bicycle. Plaintiff sued the City and County of San Francisco for negligence.

Contentions

PLAINTIFF'S CONTENTIONS: Plaintiff contended that while he was riding his bicycle he hit a significant defect in the road which caused him to be ejected from the bicycle. As a result of the impact, plaintiff suffered severe bodily injuries. Thus, plaintiff contended that the City was was negligent in failing to repair the defect on the road. Plaintiff also contended that defendant failed to warn about the dangerous condition of the road defect.

DEFENDANTS' CONTENTIONS: Defendant denied plaintiff's contentions.

Result

Defendants agreed to settle the claim for $120,000.
