Plaintiff Environmental Research Center, a California non-profit organization, filed a lawsuit against Defendants Y.S. Royal Jelly & Honey Farm Inc., individually, Y.S. Organic Bee Farms, and Y.S. Eco Bee Farms for alleged violations of Proposition 65 under California's Safe Drinking Water and Toxic Enforcement Act of 1986.
Contentions
PLAINTIFF'S CONTENTIONS: Plaintiff contended Defendant Y.S. Royal Jelly & Honey Farm Inc exposed consumers to lead, which was found in Defendant's products, including its Y.S. Eco Bee Farms Pure Inner Forces Propolis Golden Seal Echinacea. Lead is a chemical known in State of California to cause cancer and reproductive harm. Plaintiff additionally contended Defendant failed to warn consumers that they had been exposed to lead as required under Proposition 65.
DEFENDANTS' CONTENTIONS: Defendants denied Plaintiff's contentions and denied any wrongdoing.
Result
The case settled for $90,000, which included $6,030 in attorney fees. Moreover, Defendants were enjoined from selling the products unless they were reformulated or provided warnings to consumers.
