Facts

Plaintiff Larry Hudson filed a class action and Private Attorneys General Act lawsuit against defendants Sterling Jewelers, Inc. or Signet Jewelers Limited in 2017 for an alleged failure to pay overtime wages, provide meal periods, reimburse business expenses, provide accurate wage statements, and timely pay wages.

Contentions

PLAINTIFF'S CONTENTIONS: Plaintiff contended that defendants violated California wage and hour laws by failing to include incentive compensation in the calculation and payment of overtime wages and did not provide meal periods and/or meal period premium compensation at the regular rate of pay, as opposed to straight hourly rate. Further, plaintiff contended that defendants failed to reimburse the cost of cell phone expenses and timely pay wages.

DEFENDANT'S CONTENTIONS: Defendants denied plaintiff's contentions.

Result

The court awarded final approval of the class action settlement in the amount of $1,500,000.
