Facts

Plaintiff Dennis Curtis Hisle is a prisoner under the custody of Pleasant Valley State Prison. While incarcerated, plaintiff had difficulty breathing and suffered from severe pain. Defendant Dr. Marylyn Conanan conducted an x-ray which revealed that plaintiff had three broken ribs and internal bleeding. Despite the x-ray results, plaintiff was ordered to return to his cell. On May 21, 2016, plaintiff was rushed to Mercy Hospital for treatment. While suffering from internal bleeding, defendant Dr. Mushtaq Ahmed kept plaintiff in a hospital for two weeks due to the lack of space at Memorial Hospital. When plaintiff arrived at Memorial Hospital, a surgical procedure designed to extract blood failed due to the delay in treatment. Plaintiff sued defendants in violation of his civil rights under 42 U.S.C Section 1983 for deliberate indifference to a serious medical need.

Contentions

PLAINTIFF'S CONTENTIONS: Plaintiff contended that defendant Dr. Conanan falsified medical records with respect to plaintiff's grievances detailing the cause of plaintiff's injury. Plaintiff contended defendant Dr. Conanan failed to order a medical lay-in for plaintiff. Plaintiff also contended that defendant Dr. Conanan failed to timely issue a referral for plaintiff to see a pulmonologist.

DEFENDANTS' CONTENTIONS: Defendant denied plaintiff's contentions.

Result

The court granted Dr. Conanan's motion for summary judgment.
