Facts

Plaintiff Highridge Condominiums, Inc., filed this lawsuit against the developer of the project, Glenmont Cal-Coast RPV, LLC. The below grade parking structure at the project leaked, cracked, and showed efflorescence throughout. Additionally, visible damage at the exterior of the project included significant stucco cracks and loose or damaged floor tiling throughout common area walkways. In addition, leaks at the private balcony decks caused damage to the interior of units and soffits below the decks. Window leaks caused damage to framing, drywall and flooring. Finally, decorative tiles on the sides of the buildings started to fall off and were a health and safety concern.

Contentions

PLAINTIFF'S CONTENTIONS: The association contended that these various conditions were construction defects and violated the performance standards set forth in Civil Code Section 895 et seq.

DEFENDANT'S CONTENTIONS: Defendant denied all allegations.

Result

Following multiple mediations before mediator, Ross Hart, Esq., the case settled for $1.4 million.
