Contentions
PLAINTIFFS' CONTENTIONS: Plaintiffs contended defendant paid less than the minimum wage for the time they spent doing non-sales work. They further contended that defendant improperly averaged their commissions, failed to pay overtime wages, and failed to provide meal and work periods. Lastly, plaintiffs contended defendant failed to pay all wages owed upon separation and failed to provide accurate, itemized wage statements.
DEFENDANT'S CONTENTIONS: Defendant denied the contentions.
Result
The parties agreed to settle for $6.5 million. In addition, defendant agreed to change its policies, including to provide breaks.
