Richard Winters filed a class action lawsuit against apple cider maker Two Towns Ciderhouse, Inc., seeking damages and injunctive relief against the company.

Contentions

PLAINTIFF'S CONTENTIONS: Plaintiffs contended that defendant violated various advertising and unfair competition laws in the state by the manner in which its products were labeled. Defendant intentionally placed misleading and false claims of the ingredients used. Though defendant was aware that its product contained Malic Acid, it misled consumers to believe its drinks instead contained non-artificial L-Malic Acid.

DEFENDANT'S CONTENTIONS: Defendant denied the contentions.

Result

The court approved a settlement agreement between the parties in the amount of $985,000.
